I believe it is legal to pass on the right at least in Calif.

The problem is idiot, discourteous drivers that just get in the left lane and stay there regardless of what other traffic is doing. Especially the ones that pace the car next to them and have an open road in front. Either speed up and pass or slow a little and move over.

I taught my kids to always move over if someone is coming up behind them regardless of how fast they may be driving and not to just drive in the left lane for no reason.

I drive fast often and I will move over if some jackass in their honda is coming up on me. They want to drive faster than me, no problem

German truck drivers have a solution to that problem. Two of them will pace each other side by side. When they reach the merge point, one lets the other in front. It makes the traffic flow much smoother through those work areas.
