You don't want to be charged with being at fault. It could increase your insurance cost. Even if you later get insurance from another company (and personally I highly recommend AAA) they ins companies do communicate with each other and it could cause you higher rates, etc. Besides, you did nothing wrong. If the police report says you were not at fault, it should be pretty hard for them to say otherwise.
Just remember, the insurance company IS NOT your friend and DO NOT have you best interests in mind. They want to settle it for as little $$ as they can. They happily take your insurance payments, but don't want to pay out. Unfortunately you may need to get a lawyer.
When it is all over, it will have been a good learning experience for you
