As for your highlighted statements above, again, I really hope you're not using your real name because typing such things will close so many doors for you, both on the client and side and the lawyer side, that I almost feel bad for you because you should be a lot more hip to the incredible folly of making such pronouncements. If you want to become a successful lawyer some day, you should learn that you should never #1 admit to illegal acts (certainly not before you've been admitted) -- doesn't matter if those acts were committed here or abroad, it's an admissions process subject to bar discretion and not a prosecution, you need to understand the difference before you continue making such statements. #2 never close a door unless you have something to gain. By saying "I don't need to work for anyone else, I'm not poor" you are demonstrating that you don't know the silliness of closing doors needlessly. You had nothing to gain by admitting to committing crimes, yet went ahead and made such statement on a public forum oblivious to all the ways that it could affect your admission to a state or federal bar. If I were you, I would delete this account on this forum, including all the posts and rethink your methods in public discourse. |

If I juke one way I risk juking the very way the guy was reacting trying to avoid. Better to stay where I am and hope he successfully avoids. A race track is not where I'm expecting a pedestrian and so my brain isn't processing the image even if I'm seeing it. I'm looking for debris and the normal rules of street driving don't apply. |

In car racing, there's more anger when us humans make mistakes. Since they have being preparing for the race, for your race to be over in a sec because of someone else, that's very aggravating but you should wait until out of the pits and file complaint with RD.
This video is of two racers top tier motorcycle racers. Valentino Rossi and Marco Simoncelli. They are from the same town They grew up together Raced together, Marco fell off the bike at full lean and Valentino semi decapitated him with the bike. Marcos parents said "I know that is the best way my son could of died, doing something he loved" Since the ward fam knew their son messed up and did not think, their insurance is not covering expenses. How important is the toxicology report really? I think we can all agree racing a car stoned is not a great idea, but are Wards actions in question here or are Stewart's? IF he could have missed him and wanted to scare him or clip him on purpose I don't think the fact Ward was high matters. if he hit him on purpose Ward could have been blind drunk and Stewart would still be somewhat responsible for what happened.

From the link in the first post there was this info at the bottom I just saw:
"New York law does not allow the Ward family to collect damages for their own pain and suffering but does allow parents to recover loss of expected future support and care that their child could have provided." How much could that be? It doesn't sound like it would be a whole lot compared with some sort of extravagant damages award. Maybe I read it wrong. |

If they feel negatively about the law barring families from punishing someone who contributed to their child's death, they could do an end run and award damages based on Ward's trajectory into the professional driving ranks. Being that he was driving at the level of a seasoned professional during a dirt track race, a persuasive argument could be presented (to someone unhappy with the NY law) that this may have been the next Joey Logano. Certainly if the family could show races in which Logano was beating NASCAR champions at age 20, on dirt tracks. Or alternatively, that Ward was accomplishing something that even Logano hadn't. Juries don't have to prove their decisions, it's up to the appellate process to deem it excessive or not. Not a good gamble for Stewart. |
It's very simple-- don't drink and drive.
Don't drive stoned. Don't walk, run or turn your Back to traffic on a hot Track. Or grid or pit areas For that matter It not hard. You know what you're doing Going in. |
