Hummm...you must be new to CA :-)
You can't just go throw any old engine in a car out here! Yes, there are certain years you have some flexibility (OBD 1 cars, 1996 and older as well as 1974 and older cars), but certainly not in a 2000 boxster.
There may be an appeal process he went through or something, but a 3.8 has a different or tuned ECU that will throw a code on a smog machine most likely...
