FMVSS 116 says brake fluid must be clear or amber in color. The color clause of the has been in effect for at least 2 years and perhaps much longer. Brake fluid manufacturers must have known this.

BTW: The purpose of the color standard is to distinguish brake fluid from any other car fluid because of its safety role. Blue is banned as a brake fluid color because windshield washer fluid is blue. Pretty reasonable when you think about it.
