For a tires size x/y, the x is tread width and y defines the sidewall height as % of x. Examples: 265/35 gives a sidewall of 265*0.35 = 92.75mm. 275/35 => 96.25mm. 285/30 => 85.5mm. Your proposed 275/40 sidewall will be 110mm which is significantly taller
