Need some advise

I need some help making a difficult decision. I have found a 2004 S with 25,000 miles in mint condition (by eye at this point). It is a "Special Edition". Color is Grey with a Cocoa top and interior. I love the color combination. I would buy this Boxster and then sell mine. Here are my questions?

1. They were asking $29,995 a few weeks ago. I told them they were way overpriced and would need to come down some. A week later I went back and the car had been sold. I was a little sad but moved on. Went by yesterday and it was back on the lot. Salesman said the deal fell through and they have marked it down to 26,500. Is this still a little high for this car?

2. What does the special edition ad to the vehicle over a standard S? Salesman said an additional 5 hp but I have never heard of that.

3. Obviously I am concerned about the IMS issue. I now have a double row 2000 box with 67,000 and it runs perfect. With the advent of the IMS lawsuit, if i purchase this 2004 and have a failure would it be covered under this lawsuit and qualify for a replacement engine?

Any advise would be appreciated by all the experts here. Of course I would get a full PPI from my Indy before I pull the trigger.
