School got involved today, in my favor, they are tired of the other kid saying things :matchup:. Talk of the other kid wanting to sue, I really don't see what leg he has to stand on. His parents do bail bonds as a job so while we have connections with lawyers and such I am sure they do too, but as I said I don't see what they can do that doesn't just incriminate themselves further.

Big Jake I feel sorry for you with your accident. I had a minor incident/accident about five years ago with my small Nissan suv. I hardly could contain my anger at the guy that sideswiped me . It was only a $1 k damage but I started getting p-ssy with the offender and giving him deadlines for remedy. Then I calmed down and let my insurance co. handle it. It really upset me for about a week, time consumed, running around getting claim quotes etc. Yours is way worse than mine was.

In addition I would try and stay calm and know your rights. Fortunately you are not hurt? And I trust you will get another car out of it?

I'm not sure how insurance works in Texas (no fault) but here if you pull out of a parking spot and rear end someone it's a given that it's your fault entirely.

But definitely get a lawyer to deal with your insurance company since its also the other side's insurance company.
Make sure they have it as 100% the other guy's fault because at your age you don't want any of that blame.
Once you get your check I'd consider a new insurance compay because I have feeling that your insurance will msyteriously go up.

Take the high road, bud. Let them crow all they want. At the end of the day you and the police know where fault lies. It's all about actual damage cost and zero to do with ego and he said / she said.

Personaly i see this as an opertunity to capatalize on, i was already looking at S's yesterday, and would be pretty chill about it if I only wouldnt have been hit by of all people litterally one of the only students in the school i absoloutly do not get along with, never have. His friends of course are getting inovled and his mother despite non of such being witnesses. I cant wait to stop dealing with the low life other party and to start dealing with insurance, recoded my side of the story with their adjuster today, they are playing phone tag with the other party... go figure, they sure have time to say stuff everywhere else but mouths shut when talking to the company.

The insurance claims that they have to pay out either way so they do not really care, but yeah i am pretty upset with the situation, and we are still undecided on a lawyer, at the time we are in relations with the police chief or something asking for a better report from the officer or something more detailed.

oh they care. They're out money on this one (I'm sure they incentivize their adjusters accordingly) and now they're going to find a way to limit that loss. There is no question that in this situation a person without a lawyer is going to get the worse deal than one with the legal letterhead on all their communications. These lawyers know the ins and outs of this very type of situation. When you go solo, they've got you right where they want you.

I dont care about anything really until the liabality is settled, imagine you because a suspect in the murder of your wife and people actually belived it was you, Dealing with insurance will be a walk in the park, we will weezle every bit out of the situation and not allow my life to be to any exstent worse than it was the day before this happened, i just to move on and get to that phase and get past all the other childish games the other party is dishing out.

You don't want to be charged with being at fault. It could increase your insurance cost. Even if you later get insurance from another company (and personally I highly recommend AAA) they ins companies do communicate with each other and it could cause you higher rates, etc. Besides, you did nothing wrong. If the police report says you were not at fault, it should be pretty hard for them to say otherwise.

Just remember, the insurance company IS NOT your friend and DO NOT have you best interests in mind. They want to settle it for as little $$ as they can. They happily take your insurance payments, but don't want to pay out. Unfortunately you may need to get a lawyer.

You need to demand in writing with your insurance company that they subrogate your claim - and go after the other party for all damages including your deductible - as the accident is 100% the other person's fault.

I had to do this once and it worked to get my deductible back when the insurance company would have otherwise been happy to let me pay it and then forget about it.

So far we have not had to pay any deductibles or anything yet, the car will be appraised soon and that too will not be charged until after the liability is resolved. We are also keeping the car on our property since we would be charged for them to store it

How can there be a liability issue. You were driving in the lane and they were not parked properly and pulled out of the parking area and hit you. If the police say it was their fault, it simply is.

Don't wait for more BS to surface from the other kid. Stay on top of the ins company and keep them from dragging their feet. The damage appraisal and settlement is seperate from who was at fault. This was not your fault. You are the one who has suffered and they need to make you whole. That includes either replacing your car, fixing it to your satisfaction or paying you for its replacement. This should not cost you a penny..

Getting an appraisal should not take more than day or so. I would get your own independent appraisal as well. Take the car to the best body shop in town, one that specializes in high end cars, as well as the closest Porsche dealer for appraisals. That way if they try to low ball you you have some ammunition to dispute it.

Also unless it is different in your state, you can get it repaired (assuming it is repairable and not totaled) where ever you want, not the cheap ass place the insurance company may recommend or send you

Here in China, you have 48hrs to appeal the official (police) decision. Once initiated, it all takes a long time and both cars gets impound during the process. Do you guys have the same in the USA?

I'm guessing the same.... the one at fault would need to sue using the regular lawyer/judge/court way? It is how it is usually done there?

Ask your agent how many days they would gladly want to be without their Porsche. It's been how many days now? What progress has your insurance company made exactly in getting you back on the road?? Ask them where they are in the process and exactly what you can expect.

Stay on them! Insist this moves forward today as per the police report, no further delay. You are at a loss every day you are without your vehicle or even a loaner.

Cars are only impounded here generally if you have an obscene number of parking tickets or if you kill someone like a cyclist (which happened to a colleague of mine) requiring a mechanical inspection of your brakes.

Then still doesn't make sense to me why any party would need to hire a lawyer. I was convinced the insuranceCo' adjuster had a black book in hand and was quoting accordingly - in case of total loss anyway. Lawyers or not, not sure with what they could assist.

Re repairs, that's defined by the adjuster as well or they normally leave it to an insusranceCo' appointed bodyshop to quote? or is that the same..... confusing
