FINALLY HAVE A RESOLUTION. On December 10, 2008 (yesterday), we had a scheduled arbitration hearing in New York. During the hearing, they asked for an opportunity to settle, and after mutual negotiation, they agreed to what my lawyer and I felt was a fair settlement and I accepted via my lawyer. It was entered into the hearing and they will be paying me $12,972.++ within the next 30 days.
It took 13 1/2 months, and 1 more until I actually get the $$$, but I had no intention of letting them out of their commitment that they contracted with me for. They had to pay their arbitration fees as well, so in the end they will be paying out more $$$ then if they had initially honored my claim in the beginning. This Christmas will be so much better for me and my family now then it was last year. Take care and thanks to everyone that made suggestions or had words of commisseration or support, Mike |
It sucks you had to go through all of that, but at least they paid up. I am glad to hear they ended up paying more than they needed too because they were jerks.

did they pay for your legal fees?
I have them as well and I have not documented my oil changes at every 5K miles. If my motor goes I guess I am screwed. |

I am in the exact situation you are in and i have a lawyer willing to help me out. My warranty is with Great Lakes Warranty though.

So did the lawyer take half of the settlement?

Persistance pays off. Great work, Thenavarro! It is always in the details.

wow that really sucks. So much for piece of mind....
I bought an extended warranty four years ago (CWS) and rather than pay it all up front I decided to go with the longest payment schedule possible. After the parking brake switch went out ($4 part) and they denied the claim I decided to stop paying and they terminated my contracted. Glad I didn't send them the rest of the $2K or $3K. Good job Navarro, I've screamed bloody murder countless times and threatened litigation but I never actually had to do it or bothered to. Nice to see someone do it. I would be tempted to run a full page ad in Excellence magazine about your experience. It's a small community in Pcar world. WD would hear about pronto. But then again, they would probably just stop dealing with 996/986 engines completely. So what's your next Porsche Navarro? :D |
Mike, I am so glad that you persisted and made the rascals pay. I have told everyone I know about the shoddy treatment that Warranty Direct gave you. I had coverage with them on my '03 Boxster S but never had a claim. Transferred the coverage to the buyer. Don't know if he has tried to collect on any claims. I will never do business with them again.

Simply stated, you need to raise your level of persistence and tolerance for debauchery. You don't need to put an ad in a magazine that some slick lawyer can turn into libel against you and frankly I sincerely doubt they would run it. Every day you should somehow being putting a foot in their ass, make it easier to pay you and trust me that is what they will do..
